Basically, you need legal advice. VISA may have the right to restrict explicit discussion of clearly illegal acts, but there are (or should be) limits. For example, "Lolita" is the title of a classic novel and a proper name. Is VISA going to go after Amazon.com for using that word on their site to sell the book and the two movies based on it? If they can get away with censoring a proper name, can they censor "Dolores"? ("Lolita" is "short" for "Dolores"). What about "Bob" or "Mary"? Is there any limit to this?

Is VISA going to be permitted to censor any discussion forum for crime victims or abuse victims that uses words that describe illegal acts?

Clearly a law suit is in order and NCSF and ACLU either should help or stop asking for contributions. If this isn't a civil liberties issue, what is?

I know this is repeating an old topic, but what about accepting checks, money orders, or traveler's checks? I know it's not as convenient, but it's better than shutting down the site.

By accepting these, you can offer several payment options. I would pay yearly if that option was available, but lesser time periods could be priced and listed also.

Just a thought...

Not really. There is nothing in the constitution that says a company has to do business with another business if they don't like the sexual content involved.


Given VISA and Mastercard's stranglehold of the market, is any of your
anti-trust legislation an option?

There would appear to be legal precedent supporting our right to say what we want on some private property; I hope that's a given and understood. What's unclear, as near as I can tell, is whether a company like Visa can interfere with the right of free speech made by its customers.

I just had a post pulled last night because of mentioning....uhm...well.....let me put it this way...

24 yrs ago, i planted a little flower on this vastly earth. it took that flower 21 years to pollenate and produce another flower - altho much like the original plant, the new flower is delicate and unique in a manner all its own. the problem was that a nasty wind blew up and carried that new pollen very far away and i was unable to locate the new flower. quite by chance and totally unexpected - an aroma of familiarity came over me - and when i glanced down - that little flower was there.

as the gardner of the original plant, i was filled with pride and joy at how beautiful the new little flower was. now i hope to be able to admire it and watch it mature into all it's beauty.

so, well...anyways. censorship sucks and i promise no more mentioning of flowers or poorly written parodies.

i run my own business and know full well that even in America - freedom is not necessarily "being free" - we all have rules we must live by.

aiken - thanks for doing all you can do, to keep a site such as this - alive and well.

You might want to read some of the cites I provided (at least) before spouting your opinion, if you want to be taken seriously. Coporations based in the US have similar rights and responisiblities that citizens do.

You could, of course, offer evidence to the contrary. I'd be far more inclined to give your assertion credence if you offered some supporting evidence.

This is a very sad News, indeed...
As a Disabled American, long suffering from Tourette Syndrome I am appalled at the current trend of eroding our constitutional rights, particularly through the Patriot Act.
I believe that most people are basically good, though...
So I would like to ask distinguished b.com members to join me in petitioning John Ashcroft to relax the stand on the usage of the word "cunt".
I, for one, am medically compelled to overuse this term, especially discussing in the forums important issues of our age with Heatherbirdie, Paisley, worthless_thang, lemursaresexy, uber_slutbucket , fxxkmesexkitten and least but not last Meatmarket....

So what about the pay websites that are actually devoted to that kind of porn? I think there are some still some sites that "pretend" it's a couple of those things you mentioned, and I think that there are manu sites still around that actually show one of those things you mentioned.

Or maybe you guys could create your own credit card and payment processing companies. I'm sure there's some NoCal VC's that would have an interest in that if the ROI is good for them, and they'd get some free pub to boot.

Eh, another site I've been to has a block set up. Rather than r**e, it sets it up as funny little catch phrases.

"rape" turns into "sweet tender kisses"

"Necrophyllia" turns into "dancing with aunt margaret"

"bestiality" turns into roasting a turkey...

things like that. I know they did it with that one chick's name a while back, so I don't see why they couldnt.

The other thing you could do is replace offending words with "<edited for content. please contact link to VISA for questions, concerns, or complaints>"

Just a thought (or two)

Well, there's always ACH... (auto-account withdrawal). My gym fees come out that way.

Or bank-to-bank wires

OR... i know my bank will do auto-payment via bank transfer. I pay my mortgage that way. I just tell the bank where to send the check, and they send it. Don't most banks have some sort of free bill pay any more?

It'd keep all the payers from having to mail the check every month.

Point well taken, but what happens in the future if the word "bondage" is added to the Visa banned words list? (As in bondage.com).

Scary thought, but that time is coming. We aren't all as free in this country as we would like to believe.
